These terms explain what you can do with Buildmax, what we promise you, and what we both agree to. Written to be read, not avoided.
Agreement
Terms of Service.
These Terms of Service (“Terms”) form a legally binding agreement between you and Buildmax (“we”, “us”, “our”) governing your use of buildmax.app and all related services. Please read them carefully.
By creating an account or using the Service, you confirm you are at least 16 years old and have the legal capacity to enter into this agreement. Our Privacy Policy is incorporated by reference into these Terms.
Acceptance
By accessing or using Buildmax (buildmax.app and related services), you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.
Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. Notify us immediately at support@buildmax.app if you suspect unauthorised access. You may not share your account or transfer it to another person.
Intellectual Property
You own 100% of the code, content, and projects you generate on Buildmax. We claim no intellectual property rights over your workspace content. The Buildmax platform, brand, and underlying infrastructure remain our intellectual property.
Acceptable Use
You agree not to use Buildmax to: build or deploy malware, spam tools, or systems designed to harm others; scrape, reverse-engineer, or attack the platform or other services; generate or distribute illegal content; impersonate other users or entities; attempt to exceed your credit quota through fraudulent means. We reserve the right to suspend accounts that violate these rules without notice.
Credits & Billing
Buildmax operates on a credit system. Credits are consumed by AI requests, planning, builds, deployments, and related workspace operations. Unused credits do not roll over unless explicitly stated in your plan. Payments, hosted checkout, customer portals, subscriptions, and invoices are handled by Polar or Polar's payment infrastructure. We do not store raw card numbers. Paid plans automatically renew unless cancelled before the renewal date. Payments are non-refundable except as required by applicable law or at our sole discretion.
Service Availability
We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, apply updates, or experience outages. We are not liable for losses resulting from service interruptions. We will provide advance notice of planned maintenance where possible.
Termination
You may close your account from workspace settings where available or by contacting support. We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, abuse the platform, or fail to pay outstanding amounts. Upon termination, your right to access the Service ends immediately. You should export any codebase you want to keep before closure.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. AI-generated code is provided as-is — always review it before deploying to production. We do not warrant that the Service will be error-free or that any generated code is free from security vulnerabilities.
Limitation of Liability
To the maximum extent permitted by law, Buildmax and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
Governing Law
These Terms are governed by applicable law. Nothing in these Terms limits rights that cannot be waived under consumer-protection or other mandatory laws. To the maximum extent permitted by law, you and Buildmax agree to resolve disputes individually and not as part of a class action.
Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or prominent notice in the dashboard. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
